REGULATIONS ON STUDENT AFFAIRS Students of Universities and Higher Colleges and Professional Secondary Schools of the Formal Training System (By virtue of Decision No. 42/2007/QD-BGDDT dated on August 13, 2007 issued by the Minister of Education and Training)

Chapter I
GENERAL REGULATIONS

Article 1 - Scope of the Regulations  


1. This regulation covers the students’ rights and obligations, contents of affairs, system of organization and management, emulation, commendation, and discipline; and


2. This regulation applies to students (hereinafter referred to as SD) of universities, academy/ college, higher colleges and professional secondary school of the formal training system (hereinafter referred to as University) .

 

Article 2 - Purposes

 

For an effective implementation of the country’s educational objectives, the Student Affairs of every educational institution is one of key tasks of the rector of university. The main purposes of the Student Affairs are to create supportive environment and innovative opportunities for student learning, to promote individual student excellence, to challenge students to take the responsibility in creating and nurturing a positive personality, to develop loyalty to the ideals of national independence, and to strengthen students’ qualities and abilities to meet the requirements in defense of the nation.

Article 3 - Requirements of Student Affairs

 

1. The students being the main character of the university, the Student Affairs of the University ensures sufficient conditions in the implementation of the students’ rights and obligations in the process of studying and training at the university; 
2. The Student Affairs is expected to comply with the guidelines and policies of the Party andState's laws and regulations of the Ministry of Education and Training; and

            3. The Students Affairs has to ensure objectivity, promotion, openness,  and          equality indealing with the students.

 

Chapter II


RIGHTS AND OBLIGATIONS OF STUDENTS

Article 4 - Rights of Students

            1.         Students are admitted to the university to enroll in their chosen  field,         provided            however, that  they have to follow the rules and regulations of the    University as            prescribed by the Ministry of Education and Training;

2.         Students are given due respect and equal treatment by the university; they are providedsufficient information about the rights to study and other practices under the provisions of the universities: students are provided rules and foundations of learning, practice, graduation exams, and training and policies of the State;

3. Students are provided facilities, intra-curricular  and other extra-curricular activities, as            follows:

a) Library materials, equipment and facilities for the learning activities, experiments,research, culture, arts, physical education and sports;

b) Scientific researches, talent competitions and Olympiad of subjects and other youthtalent creative competitions;

c) Health care  and health protection under the current system of  the State;
            d) Study abroad program/scholarships to deserving students to continue higher education levels under the current regulations of the Ministry of Education and Training;

                        e) Participation to  activities of the Communist Party of Viet Van, Ho Chi Minh            Communist Youth Union, Vietnam Student Association, Viet Nam Youth Association,     and other self-governing organizations of students,  conduct of in-campus and off-    campus social activitiesin accordance with the  regulations of laws relevant to the           activities of culture, arts and positive sports, which are consistent with the training      objectives of universities; 

            4.         Students are entitled for a leave of  absence  or suspend temporarily in studying. Further, they are entitled to: (a) take slow or rapid learning progression scheme depending on the learning ability of students, (b) study two programs at the same time, and  (c) transfer to other university in accordance with the regulations of training of the Ministry of Education and Training. Moreover, they are entitled to enjoy a summer vacation, New Year holidays, public holidays as prescribed by law;

            5.         Students are entitled to avail   priority policies of the State in accordance with the prescribed regulations, as follows: (a) they are eligible to receive scholarships provided byorganizations and individuals inside and outside of Viet Nam; (b) they are exempted to pay school fees when acting as volunteers in public services on traffic, entertainment, visiting museums,historic relic, cultural works as prescribed by the State;

 

6.         Students can recommend ideas and views regarding the development and/or solutions to some issues and concerns of the university directly or through their legal representatives;  they can also propose their wishes and appeal to the Rector of the University in  solving issues related torights and legitimate interests of students;


           7.         Students are admitted to the dormitory in accordance with the regulations of the university. The priority rule to arrange students living in dormitory is implemented under the provisions of the Regulation of affairs of boarding students of the Ministry of Education and Training;

 

8.         Students who qualified for  graduation will be issued  their diplomas, academictranscripts  and training records  and  other necessary  documents following the administrative procedures; and

9.         Students who graduated with excellent grades and outstanding performances shall be given priority option in  the employment recruitment program  of the State, in accordance with the regulations of the recruitment policies of officials and public servants.

 

Article 5 - Obligations of Students

Students are expected to:

1. Abide to  the rules, guidelines, and policies of the Party and State laws;
2. Give due respect to the teachers, staff and employees of the university, in adherence to  solidarity, mutual assistance in learning and training, thus applying a civilized lifestyle;

3. Preserve and protect the assets of the university, and  contribute to the construction, protectionand promotion of  its traditional values;

4. Perform the task of learning and training under the program, educational plans, training in the university; have active involvement to positive self-study, research, and formation and self-training in term of ethics and lifestyle;

5.  Follow strictly the provisions on health examination when seeking enrollment to the university, and adhere regularly on health check-up during the period of studies as prescribed by the university;
6. Be punctual in paying tuition fees following the prescribed timetable;
7. Participate actively on various social-cultural and environmental activities in accordance withtheir physical abilities and health status under the basic requirements of the university;

8. Comply with the obligations to work with fixed time under the command of the State when students get scholarships, free tuition fees from the State or funded by foreign countries under contract of agreements signed between the grantees and  the State; Failure to comply with the terms of agreement, student-grantees will be obliged to reimburse scholarships and training expenses in full or its  fraction thereof as prescribed in the contract;

9. Participate in the prevention and protection campaign against negative activities, namely: cheating in studying and examinations and other negative activities of students, officials, and teachers. Thereby, students are expected to report promptly to faculties, function departments, Rectors of Universities or competent agencies when students discover negative behavior, dishonesty in studying and examinations or other violations of law, breach of other  rules and regulations of students, staff and lecturers in the university; and

10. Participate in the prevention and protection campaign against crime, use of illegal drugs, prostitution, and other social immorality.


Article 6 - The Prohibited Acts Among Students

Students are strictly prohibited to:

1.  Offend the dignity, honor, or maltreat the lecturers, staff, employees and other students;

2.  Cheat during the conduct of examinations, such as copying from the work of other students,carrying suspicious reading materials in the exam room;  Moreover,  students are prohibited to secretly request  to  increase the points obtained during the evaluation; assist other students or asking someone else to study, take exam, practice and shift; copy and ask someone else to assist or write sub-thesis,  projects and thesis; and to organize or participate in helping someone else to exam or other acts of deceit;

3. Smoke and take hard drinks (beer and wine) during class hours, and likewise, to come or attend classes while heavily drunk with alcohol/beer;


4. Disturb the security / peace and order inside the university premises or public places;

5. Participate in car/vehicle racing or cheering illegal racing of vehicles;

6. Gamble in any forms.

            7. Produce, trade, transport, distribute, store, use or entice others to use weapons,            explosives, narcotics, prohibited chemicals, material documents, publications,      information of reactionary and depravity and other prohibited  documents  under    the       provisions of the State; Further, students are prohibited  to organize, participate, spread        superstitious activities,religious activities in universities and other unethical behaviors;           and

            8.  Establish and participate in political activities which are illegal in nature; and to        organize and      participate in collective activities in the name of the university without       approval of the Rector.

 

 

Chapter III



CONTENTS OF AFFAIRS OF STUDENTS


Article 7 - The Administrative Organization

The Office of Student Affairs shall:
1. Organize admission of successful students under the provisions of the Ministry of Education and Training and universities, arranging in classes of students; appointing interim steering boards  of classes of students  (monitors and vice-monitors) at the initial course; and to provide cards forstudents;

2. Organize admission of successful students who intend to reside  in dormitories;
3. Take statistics, aggregate data, and manage the profiles of students;
4. Organize graduation ceremonies, and prepare diplomas of students; and
5. Settle administrative affairs related to students.

Article 8 -  The Organization and Management of Learning and Training Activities ofStudents

The Office of Student Affairs shall:

1. Monitor and evaluate the attitude in learning and training of students; classify and compute the academic ratings of students based on the grades submitted by respective subject teachers at the end of each semester or academic year and academic course; organize emulation and rewards for teams and/or  individuals who gained outstanding achievements in learning and training; and, implementdisciplines for students violating regulations and rules;

2. Organize "Weekly Activities of Citizens - Students" at the beginning of the course, academic year, and at the end of the academic course;
3. Encourage students’ participation in activities of scientific research and worthy competitions, Subject Olympics, talent and creative competitions, and other encouraging learning activities;

4. Arrange affairs on education regarding political ideology, ethics and lifestyle of students, as well as activities in cultural and performing arts  and other outdoor activities, and  organize  periodicdialogues between the Rector and the students;

5. Follow-up the development affairs of the members of the Communist Party of Students; facilitate favorable conditions of students participating in organizations of the Communist Party and unions in the universities; collaborate with Ho Chi Minh Communist Youth Union, the Student Association andsocial - political organizations related to movement activities of students , create favorable environmental conditions for students trainings; and

6. Organize counseling study, occupation and employment for students.

Article 9 - Health and Sports Activities of Students

 

The Office of Student Affairs shall:
1. Organize and  implement health examination for students at the beginning of the academic course; conduct periodic health check-up to take care, prevent and protect the students from epidemics, and diseases; and arrange medical treatment of students who are not physically fit to study;

2. Provide sports facilities for students’ fitness and games amusements;  organize physical training and sports activities for the students participation; and
3. Organize a cooperative canteen management for students to ensure hygiene and food safety.

 

Article 10 - Implementation of Regulations and Policies for Students’ Assistance

The Office of Student Affairs shall:
1. Organize the  implementation of the State's regulations and policies regulated for students  onscholarship, fee tuition, welfare, insurance, credit, training and other benefits ; and

2. Facilitate the needs and requirements of students who belong to the disadvantaged group and arephysically disabled. 


Article 11 -  Implementation of  Socio- Political Security and Order, Safety, Prevention and Protection against Crime and other Social Harms

 

The Office of Student Affairs shall:

1. Coordinate with sectors and local administrative authorities where the university is located, and the residences of students to ensure the safety, peace and order of students, and likewise to solvepromptly issues related to students;

2. Disseminate information and educate students law on traffic safety,  prevention and protection from crime, drug abuse, prostitution, HIV/AIDS and other activities; and provide guidance to students in their compliance to laws,  rules and regulations; and

3. Provide counseling legislation, psychology and society for students.


Article 12 - Implementation of Activities on Student Management Inside and Outside the Dormitory Premises

The Office of Student Affairs shall organize and implement the management of students inside and out the dormitory premises based on the provisions of the Ministry of Education and Training.

 

Chapter IV

THE SYSTEM OF ORGANIZATION AND MANAGEMENT


Article 13 - The Organizational System and Management Affairs of students

The organizational system and management affairs of students includes the Rector, Unit-in- Charge of students, Teacher-in-Charge of classes, and students.

Pursuant to the regulations of the University for each training level, the Rector stipulates the system of organization and management of students for appropriate implementation of contents of affairs ofstudents.

 

 

Article 14 - Responsibilities of the Rector

 

The Rector shall:
1. Be responsible in directing and organizing the management of activities of students;
2. Organize and direct the implementation of guidelines and policies of the Party and laws of the State and regulations of the Ministry of Education and Training, sectors and localities in the affairs of students, ensuring justice, promotion, openness, and equality in the affairs of students; and implement appropriate measures for the  smooth operation and management of the rights and obligations of students;

3. Manage the  students in terms of learning and training by organizing annual dialogue with studentsto explain the guidance and policy of the Party, State, thus providing the necessary information  tostudents leading to clear understanding of the students’ aspirations in life, and answering  promptly frequently asked questions of students;

4. Ensure conditions in promoting the role of the different organizations, namely: Ho Chi MinhCommunist VN Youth Union Association, and Viet Nam Students Union  focusing on education ofpolitical ideology, ethics and lifestyle of students; and


5. Make decision of participation of students as representatives of the university, in cases  of mobilization of locals, all administrative levels, sectors or other organizations.

Article 15. Unit in charge of student affairs
Pursuant to the rules of the university for each training level, the rector stipulates functions and tasksof the unit in charge of students affairs, to help the rector implement contents of students affairsunder the provisions of Chapter III of this Regulation.

Article 16. Lecturer in charge of the class

Based on the specific conditions of the university, the unit in charge of students affairs, under authority of the rector or the dean of the faculty, assigns lecturers in charge of classes or assistantsof faculties and the unit in charge of students affairs (hereinafter referred to as lecturer-in-charge)to guide activities of  the class.

Article 17. The class of students

1. The class held includes students who are the same field and academic course and maintain stablythroughout the course. For undergraduate students studying under the credit training system, in addition to arrangement these students  to organize and manage the implementation of learning and training tasks, activities of unions and society, emulation,  reward or discipline, students registering to study the same module are arranged into the credit class under each semester.

2. The steering board of the student class includes

a) The monitor and the vice-monitor selected by all students of the class and approved by the rector (or the head of faculty or unit in charge of student affair as assigned by the rector). The term of the steering board of the student class for the academic year;

b) Missions of the steering board of the student class are

- To organize implement of tasks of learning and training, daily living activities and social activitiesplanned by the university, the faculty, departments and divisions;

- To urge the class's students complying strictly with rules and regulations on studying and training. To building self-management in the classroom;

- To organize and help students available difficulty in learning and practicing. To contact, on behalfof students of the class, the lecturer in charge of the class and lecturers of departments; to propose faculties the unit in charge of student affairs and the directory board of the university to solve issuesrelated to rights and obligations of students in the class;

- To collaborate closely and regularly with organizations in Ho Chi Minh Communist Youth Union, Viet Nam Youth Union Association and Vietnam Student Association in the class's activities.

- To report fully and accurately about the situation of study and training upon a semester, anacademic year and unexpected issues to the faculty or unit in charge of student affairs;

c) The rights of the steering board of the student class:

Priority points on training and other regimes are added according to regulations of the university
3. The steering board of the credit class includes the monitor and the vice-monitor nominated by  the university. The steering board of the credit class is only report the compliance of rules and regulations of students in class to the unit in charge of student affairs. The steering board of the credit class is to add priority training point and other regimes as prescribed by the university.

 

Chapter V


EMULATION, REWARD AND DISCIPLINE


Article 18. Contents and form of emulation and commendation

1. Emulation and commendation in regular for individuals and collectives of classes haveachievements to praise and encourage timely, namely

a) Winning in the students excellent competitions, Olympic competitions of subjects and having value scientific research project;

b) Contributing effectively in affairs of the Communist Party, the Youth Union, the student Associations, in activities of the youth vanguard team, volunteering students and maintaining security and order, activities of the class, faculty and dormitory, society, culture, performance and sports;

c) Gaining achievements in rescuing accident people, brave to catch criminals, fighting against the negative activities and corruption;

d) The special achievements

Contents of regular commendation are specified by the rector.

2. Emulation and commendation are comprehensive and periodical for individual and collectivestudent classes are taken at the end of a semester or academic year, namely:

a) For individuals of students:

- The individual title of commendation consists of three types: good, excellent and outstanding excellent

- Criteria for classifying honors individuals are as follows:

+ Students are awarded with the title of good students if their classification of study and training gains from good rating;

 + Students are awarded with the title of excellent students, if their classification of study gains from excellent rating and that of training gains from good rating;

 + Students are awarded with title of outstanding excellent students, if their classification of studyand training gains outstanding excellent rating;

Studying classification is determined in accordance with the Regulation of training for each traininglevel. Training classification is determined in accordance with the Regulation of training for theevaluation of training results

- The individual title is recorded in student's profile.

- There is not consideration of reward for students with discipline punishment and below average scores on the 1st final exams of modules at the semester or that academic year.
b) For the collective student class:

- The title of the collective student class includes 2 types: the Advanced Student Class and the Excellent Student Class.

- It is to gain the title of the Advanced Student Class if the class achieves the following criteria:

+ There are 25% of students gaining the title of good students or higher title;

+ There are students gaining the title of excellent students or higher title;

+ There is not any student grated dissatisfied study or poor training and punishment from warning level;

+ The collective class is solidarity, mutual assistance in education, training and organization of many activities to emulate and response positively movement of the university.

- It is to gain the title of the Excellent Student Class if the class achieves the following criteria of the Advanced Student Class, there are 10% of students gaining the title of excellent student or higher title and there are students gaining the title of outstanding excellent students or higher title

 

Article 19The order and procedures for considering commendations


1. At the beginning of the academic year, the University organizes for students, Student Classes to registering titles of emulation individuals and Collective Student Classes.

2. Procedures for considering commendations:

a) Based on the achievements in studying and training of students, a list is made up by the Student Class together with statements of the personal achievement and collective class. Those statements are certified by the lecturer in charge of class. The class proposes the faculty or the unit of student affairs for review;

b) The faculty or the unit of student affairs organizes meetings to consider and recommend to the Council of emulation, commendation and discipline of the university to approve;

c) It is based on the proposal of the faculty or the unit of student affairs, the Council of emulation, commendation and discipline of the university organizes to review and propose the rector forrecognizing the title of individual and the collective student class.

 

Article 20. Mode of discipline punishment and contents of violations

1. The students have behaviors of violations. It is based on the nature, extent, consequences ofbehavior of violation, they are suffered from one of the following disciplines form:

a) Reprimand: it is applied with student having the first violation, but this violation is mild level;

b) Warning level: it is applied for students in status of the warning level, they are repeating violations or mid violations level. However, behavior of violations have regularly nature or the first offense but the level of relative seriousness;

c) Suspending study for one academic year: it is to apply for students who are within warning period and still have discipline violations or serious violations of behaviors that student should not do;

d) Force to drop out of university: It is to apply to students, who are in the period of studysuspension. However, they are still to continue to violate discipline or the first offense with the nature and extent of serious violations, resulting in negative impacts to the university and society; they are law violation and imprisoned (including cases of imprisonment or suspended sentence).

2. Type of discipline punishment of students must be recorded in the student's profiles. In case,  students are suspended for one academic year and dismissed from the university, the university should send the notices to local and family of students for managing and educating.

3. Contents of violations and disciplinary framework are implemented in accordance with the Appendix to this Regulation.

 

Article 21. The order, procedures and disciplinary reviewing profiles
1.  Procedures for disciplinary consideration:
a) Students available behaviors of violations have to write the statement of self-criticism and receive discipline type.
b) The lecturer in charge of the class holds meetings with the collective student class, analies andpropose disciplinary type to the faculty or the unit of student affairs;

c) The faculty or the unit in charge student affairs considers and recommend to the Council ofemulation, commendation and discipline of the university;

d) The Council of emulation, commendation and discipline of the university organizes meetings toreview discipline. The Council includes members of the Council, representatives of the collectivestudent class having breach students  and students availability of breach behaviors. Students of violations are invited but did not attend in (without a good reason), the Council is still to carry out the meeting and review additionally regarding lack of positive attitude in complying with discipline.

The Council requests for applying form of discipline, proposes the rector for making decisiondisciplinary in writing.

2. Profiles for treating discipline of students:

a) The statement of self-criticism (in the case, students available faults do not write  the statement of self-criticism, the Council is still to carry out meetings to deal on the basis of evidence gathered);

b) Minutes of the collective class meeting to review breach students;
c) Opinion of the faculty or the unit in charge of student affairs;
d) The related documents.

In case of sufficiency of  evidence about students of  legal violation, rules, regulations, the unit in charge student affairs, after consulting with the Dean of the faculty, representatives of Ho Chi MinhCommunist Youth Union, Viet Nam Youth Union  Association  and Viet Nam Students Association(if any), established profiles to submit to the rector making decision discipline form.

 

Article 22. Invalidation of disciplinary decisions

1. In case of reprimand disciplined form: after 3 months from the date available the discipline decision, if students don’t repeat or no violations serious enough to be disciplined, the disciplinary decisions shall be automatically invalidated and entitled rights of students from the date of effected termination of the disciplinary decision.

2. For students with a warning disciplined form: after 6 months from the date available the discipline decision, if students don’t repeat or no violations serious enough to be disciplined, the disciplinary decisions shall be automatically invalidated and entitled rights of students from the date of effected termination of the disciplinary decision.

3. For students with suspension of study and forcing to go homeland: When the expiration of the suspension, students must present the certification of local administration of communes, wards or towns where they reside on the good observance of civil obligations in the locals. The university will be based on the certificate to consider and admit student to continue study.

4. Competent authorities making disciplinary decision must give clearly the provision of disciplined duration of student from the date of the disciplinary decisions by the discipline expired time as prescribed .

 

Article 23. Organizational structure and missions of the Council of Emulation, Commendation and Discipline of students

1. Organizational structure of the Council of emulation, commendation and discipline of students: the rector make decision to establish the Council of emulation, commendation and discipline ofstudents to monitor the issue of emulation, commendation and disciplining of students in the university.

a) The Chairman of the Council is the rector or the vice rector authorized by the rector;

b) Permanent person of the Council is the dean of the unit in charge of student affairs;

c) The members are representatives of the relevant faculties, divisions, departments, Ho Chi MinhCommunist Youth Union, Viet Nam Youth Union Association, Viet Nam Student Association of the university (if any).

The Council may invite representatives of student class (the monitor or the secretary of the Youth Union) and lecturer in charge of the class available students who are rewarded or disciplined. These members are involved to express their opinions and propose types of the reward or discipline, but they are not to have rights for voting.

2. Missions of the Council of emulation, commendation and discipline:

a) The Council of emulation, commendation and discipline is a key consulting unit to help the rector to deploy the duty of emulation, commendation and discipline of students and under the direct leadership of the rector;

b) It is based on current regulations and recommendation of the faculty and the unit in charge of student affairs, the Council of emulation, commendation and discipline will review a list ofindividuals and student classes available achievements to propose to Rector to commend or requesthigher leader to reward; it considers and recommends the rector to make decision for breach students;

c) The Council of emulation, commendation and discipline of students has every meeting per semester. When necessary, the Council of emulation, commendation and discipline can meet theextraordinary session.

Article 24. The rights of complaint about emulation and commendation


Individuals and collective student classes seen that they are not satisfied about forms of commendation and discipline, they may appeal to those departments or function divisions or the rector; if the university level has reviewed, they are still feel satisfied and can complain to the competent authority under the provisions of law on complaints and denunciations.

 

Chapter VI
Organization of Implementation

 

Article 25. Collaboration

 

Universities cooperates actively and closely with organizations of unions, student's families, therelevant bodies in localities to implement well the student affairs.

 

Article 26. Reporting Regime


1. At the end of academic year, Universities organize the final review meeting to assess  student affairs, reports the Ministry of Education and Training.


 2. Universities promptly report to the Ministry of Education and Training and the management agencies directly related incidents occurred related to students.

 

Article 27. Inspection, testing, reward or discipline

1. Ministry of Education and Training, facilities of education and training and universities are according to competent authority, organization of the inspection and examine the implementation ofstudent affairs


2. Universities, units and individuals have achievements in the student affairs will be of the commendations as prescribed.

3. Individuals violating regulations on student affairs, depending on the degree, will be treated according to regulations.

THE REGULATION
Affairs of Boarding Students at Educational Institutions of the National Education System 
(Issued together with the Decision No. 42/2007/QD-BGDDT
dated on August 13, 2007 of the Minister of the Ministry of Education and Training)
 

 

 

Chapter I
GENERAL REGULATIONS

 

Article 1. Scope of adjustment and application for students

 

1. This Regulation stipulates affairs of boarding students in Educational Institutions of the National Educational System including: rights and obligations of boarding students, contents of affairs of boarding students, system of organization and management

 

2. This regulation applies to boarding students (hereinafter referred to as boarding students) of Educational Institutions of schools, regular education, graduate education, professional secondary schools (hereinafter referred to as the schools); relevant institutions and individuals.

 

3. Students in boarding ethnic minority schools implement the regulations on boarding under regulations of boarding ethnic minority schools.

Article 2. Requirements of affairs of boarding students.

1. Strictly complying with the policy, guidance of the Communist Party, policies, state laws and regulations of the Ministry of Education and Training.

2. Ensuring closely and regularly coordination between the universities and the police, localauthorities and student's family promptly resolve the incident related to students and security andpublic order, safety, cultural in dormitory.

3. The accommodation campus or dormitory (hereinafter referred to as the accommodation campus) must have  minimum conditions and facilities to ensure for requirement of study and daily living ofboarding students; availability of equipment for preventing and distinguishing fire and protectingenvironmental.

Article 3. Accommodation Campus 

1. Accommodation campus is the place for students staying temporarily in duration of study at the school, organized and managed by school.

2. The accommodation campus must have a name plate located at the main entrance. On the name plate is written clearly name and full address in Vietnamese.

3. The accommodation campus must have the Rules Template put in easily observed place; duty room, working office of the management board; have the means to serve information, disseminates of propagation for boarding student.

4. House, living room, common rooms must have plate of house name, number of rooms, names of common room

5. Activities of superstition and religion are not organized in the dormitory under any form.
6. There is the area to keep transport means of students in safe and convenient.

7. There are types of services and conditions ensuring for daily living students.

 

Article 4Priority students living at dormitory


Upon receiving the boarding student, if number of students, who wishing to live at dormitory, isgreater than receiving capacity of the dormitory, the priority order is as follows:

1. They are heroes of the people's armed forces, labor heroes, war invalids, sick soldiers,beneficiaries of policies and disable students.

2. Students are children of martyrs, war invalids, sick soldiers, beneficiaries of policies such as children of people contributing significantly to the country.

3. Students have permanent resident census in mountainous areas and areas of extremely disadvantage socio - economic conditions.

4. Students have parents from ethnic minority groups

5.  Students are orphan losing both parents.

 

6. Students are children of poverty households and sub-poor households under current regulations of the State.

7. Students are women.

8. Students actively participate in activities organized by schools, Ho Chi Minh Youth Union, theStudent Association, the dormitory the society organizations.

 

Chapter II


RIGHTS AND OBLIGATIONS OF BOARDING STUDENTS

Article 5. Rights of boarding students

1. Students are respected and treated equally; lived in and used equipments in the dormitory according to the accommodation contract signed with schools (or the dean of the management board) to serve learning and daily living activities.

2. They are participated in activities serving cultural and spirit life. These activities are organized by the school in the dormitory.

3. Students are ensured security and order, safety and environmental hygiene in the dormitory.

4. Students can propose to the dean of the Manage Board of the dormitory and the school solutions to contribute to building the dormitory in civilized, clean and safe. They are entitled to propose andto appeal to the head of the management board of s the dormitory of the issues related to rights andlegitimate interests of students in the dormitory.

 

Article 6The obligations of the boarding students


1. Implementing temporary registration in accordance with regulations of the current Resident Law.If students are one day absent or more at the dormitory, students must notify the management board of the dormitory.


2. Complying regulations of the accommodation area on reception guests in living rooms, self-studyhours. It does not cause impact to study and activities of other students in the room and the dormitory when organizing cultural and performed events. Uniting and implementing ​​cultural andcivilized life style in the dormitory.

3. Saving electricity, water, preventing and protecting from fire and explosives and having consciously preserving and protecting the common assets of the dormitory.

4. Paying fully and timely boarding fees as stipulated in the contract.

5. If students make damage, loss of property of the dormitory, students have pay compensation underthe provisions of the Management Board of the dormitory.

6. Promptly reporting incidents in the dormitory and involving into students, who violate rules, regulations and recommendations and proposals to the management board of the dormitory.

7. Actively participating in activities of culture and performance, sports, drug prevention, crime prevention, other social evils. Other activities organized by the school or the Management Board. Actively participating in building the dormitory in civilized, clean and safe.

 

Article 7. Behaviors are not done by boarding students

 

1. Renovating rooms, changing or arbitrarily moving equipments in the rooms; making disorderly, loss of security and environmental sanitation; writing, drawing and shading to impact  good-looking of room and the living area of the dormitory.


2. Transferring or sublet the barding resident contract signed with the school of the managementboard of the dormitory

 

3. Taking strangers into the room in the dormitory without permission of the management board of the dormitory.

 

4. Producing, stockpiling, using, selling, transporting, distributing to all kinds of weapons,combustible substance, explosive, toxic chemicals, drugs and preparations of drugs, documents and publications , movies, reactionary and depraved information and other materials prohibited under the provisions of the State, organizing or participating in gambling, prostitution in any form.

5. Disseminating  superstitious activities, religious activities and other activities prohibited in the dormitory.

 


Chapter III
CONTENTS OF AFFAIRS OF BOARDING STUDENTS

 

Article 8Admission of the boarding students 

Pursuant to the application of students for living at dormitory under form of application of the school; priority subjects defined as the Article 4 with legal confirmation and conditions ofdormitory and schools consider and sign the contract arranging accommodation for students at thedormitory.

 

Article 9. Affair of the management of boarding students


1. Disseminating regulations of the Ministry of Education and Training and rules of the school on affair of boarding students.

2. Taking procedures for registration of temporary residence for boarding students with the police of commune (wards, towns) or guiding students to do procedures for temporary residence registration in accordance with current law.

3. Mapping rooms and establishing monitoring notebooks of boarding students under the prescribed form (in Appendix II of this Regulation), updating fully, timely changes of accommodation ofboarding students.

4. Assigning staff to take shift 24/24 hours per day in the dormitory to resolve promptly the incidents. Checking regularly the implementation rules of boarding students in the dormitory and treating violations.

5. Organizing of self-management activities of boarding students to promote an active role and responsibility to self-students and respect collective of board students.

6. Quarterly organizing a dialogue between the directory board of the school or the management board of the dormitory with representatives from boarding students to detect promptly, resolve the legitimate aspirations of boarding students.

7. Constructing criteria of emulation between buildings, rooms in the dormitory on ensuring securityand order, environmental sanitation, good-looking rooms in the dormitory.

 

Article 10The work of security and order, safety, epidemic prevention and protection fromdisease, social evils in the dormitory

 

1. There are plans to periodically check in time to upgrade, repair and improve infrastructure works, works serving daily living activities of boarding students and other devices in the dormitory 

2. Assigning specific tasks for staff and managers and the autonomy team in the work of security and order, prevention and protection form crime and social evils in the dormitory. 

3. Promoting effectively role of unions in schools, self-management activities in the work ofstudents in the work of security and order in the dormitory.

4. Organizing propaganda, education, guidance for students on security and order, drug prevention of drugs, HIV/AIDS and other social evils.

5.  Sprayed periodically to prevent from disease in the dormitory. When detecting signs of disease, itmust immediately inform to the local health authorities to apply measures for timely treating.

6. There are permanent medical staff to carry out first aid promptly for boarding students.

Article 11The support activities for boarding students


1. Organizing of services for taking care of vehicles, public telephone, Internet, area of entertainment, recreation, sports in the dormitory in accordance with conditions of facilities and  the legitimate needs of student to create positive activities contributing to comprehensive education for boarding students.

2. Organizing rooms of self-learning, reading newspapers, watching television, cultural and performing activities serving boarding students.

3. Organizing canteen, service center, canteen serving convenient with economic conditions ofstudents and ensure of hygiene and food safety.

4. Organizing activities of counseling on psychology, health, life skills, study, vocational orientationand employment for students in the dormitory.

5. Depending on specific conditions of each school, it can have areas or common rooms for studentscook in the dormitory.

6. Establishing specifically on service activities to serve students in the dormitory.

 

Article 12Collaboration

 

1. Actively collaborating with the police and local authorities to implement effectively measures,plans to ensure political security and order and safety in the dormitory, timely handling of incidents occurred and related to in the dormitory. 


2. Collaborating with the organization of Ho Chi Minh Communist Youth Union, Viet Nam Student Association, Viet Nam Youth Union (if any) and other organizations in the school in order to organize training activities for boarding students implementing the civilized lifestyle in the dormitory.

 

 

 

 

Chapter IV
ORGANIZATION AND MANAGEMENT

Article 13System of organization and management of affairs of boarding students


The system of organization and management of affairs of boarding students of the school includesthe principal, department (divisions) of affairs of boarding students, the management board (section)of the dormitory and staff managing the dormitory.

Based on local conditions, schools, the director of department of education and training, universities, institutes, regularly education centers, rectors of universities, higher colleges,professional secondary schools, facilities of the education system regulates the system of organization and management of affairs of boarding students to have to appropriate, ensure the implementation of contents of affairs of boarding student prescribed in this Regulation.

Article 14Responsibilities of the rector (directorof the facilities of higher education and professional secondary schools 

1. Pursuant to the provisions of this Regulation, the rector issues rules and specifically regulations of affairs of boarding students in order to be suitable with specific conditions of the school andorganization of affairs of boarding students as stipulated in Chapter III of this Regulation.

2. Approving the annual activity plan of management of boarding students; plans to construct, repair,upgrade and repair of housing, canteen, the infrastructure works of in the dormitory.

3. Approving the list of students exempt or reduction accommodation fees (if any), support ofdisable students and student with difficult economic conditions.

4. Ensuring conditions for promoting the role of organizations of the Communist Party and the Youth Union in affairs of boarding students.


5. Stipulating activities of the dormitory implemented by organizations and individuals located on the campus of the school and complied with the provisions of Chapter III of this Regulation.

 

Article 15Responsibilities of the Director of the department of education and training


1. Pursuant to the provisions of this regulation, the director issues rules and specific regulations of affairs of boarding students in educational facilities of the school, regularly educational center in the area in accordance with specific conditions and each training level.


2. Organizing implement, inspection and urge of the deployment of affairs of boarding students of schools located directly in the territory under the provisions of Chapter III of this Regulation.

 

Article 16Responsibilities of the director of continuing education center, the principal of secondary school.


1. Organizing and deploying implement of affairs of the boarding students in accordance with this Regulation and specific regulations of the director of education and training.


2. Building the annual plan of activities of affairs of management of boarding students of units; approving the list of disabled student and students with difficulty economic conditions to be exempt and reduce boarding fee.

 

Article 17.  Responsibilities of the department (division) of affairs of students


1. Department (division) of affairs of students performs functions and tasks in accordance withregulations of the regulation of students of universities, higher colleges, professional secondarysystem of the formal training system and the regulations of those in the training system of both working and studying.

2. Coordinating with the management board of the dormitory in the management, comprehensive education for students in the dormitory.

3. Coordinating with the management board of the dormitory to resolve promptly incidents occurred and related to affairs of commendations and discipline of boarding students.


Article 18Management Board (division) of the dormitory

The rector stipulates to functions and duties of the Management Board (division) of the dormitory to perform the contents of affairs of boarding students under the regulations of Chapter III of this Regulation.

 

Chapter V
Organization of implementation

 

Article 19Reporting regime


1. The school promptly report to the Ministry of Education and Training and relevant agencies of serious incidents occurring in relation to boarding students.

2. Departments of Education and Training collect the situation on the affairs of boarding studentsSchools directly belonging to and managed by People's Committee of provinces and cities and private schools in the territory to report to the Ministry of Education training under prescribed form(Appendix I) before the 30th July each year.

3. The colleges directly belonging to other ministries and sectors report to management agenciesunder prescribed form (Appendix I), then managing agencies shall gather the situation to submit to the Ministry of Education and Training before the 30th July each year.

4. The universities directly belonging the Ministry of Education at the end of the academic year havereport the situation on affairs of boarding students and send directly to the Ministry of Education and Training under the prescribed form (Appendix I) before the 30th July each year.

Article 20Check, commendation and discipline

1. Departments of education and training, relevant agencies and schools and colleges under the authority organize check, preliminary report and final review and evaluation on performance of affairs of boarding students.

2. Boarding students violates Clauses 1, 2, 3, 4, 5 of Article 6 and Article 7 of this Regulation.depending on violated level, they will be disciplined by reprimand for the 1st violation and warning level if it is the 2nd violation or more  or considered and terminated the contract living the dormitory. With other violations, students will be treated discipline under the provisions of theRegulation students of university higher colleges and professional secondary schools of the formal training system, the regulation of students of those of both study and learning and regulations of secondary schools, higher schools and schools with some learning levels

                                                                                     

3. The collective units and individuals available achievements in affairs of the boarding students willbe considered commendations in accordance with regulations.

Chapter I
GENERAL REGULATIONS

Article 1. Scope of adjustment and application for students


1. This regulation stipulates non-residency of universities, academic college, higher colleges andprofessional secondary school of the formal training system. It includes the rights and obligations of non-resident students; the contents of affairs of non-resident students; obligations of the rectors, directors of education and training.

 

2. This regulation is applies to non-resident students of universities, academies college, higher colleges and professional secondary school of the formal training system  (hereinafter referred to asuniversity), organizations and individuals related to non-residency of students.

 

Article 2Definitions

In this Regulation, the following terms shall be interpreted as follows:

1. Non-resident students are students who do not live in the dormitory of university.
2. Residency is to live permanently and temporarily in a certain area on the territory of Viet Nam.

Article 3The purpose

It is  to create a legal foundation for the university to coordinate with local governments in the management and support for non-resident students to have a positive environment ofaccommodation, healthy living, learning and good practice as well as creation of conditions for students to participate and promote their capacity in building a cultural life, order, discipline,prevention and protection from crime, social evils in resident places

Article 4Requirements of affairs of non-resident students

1. Comply strictly with the policies and guidelines of the Communist Party and legal policies of the State and regulations of the Ministry of Education and Training and the provisions of local government.
2. Understand the situation of students and students; resolve promptly collaboration issues related tostudents and non-resident students.

3. Ensure close and regular coordination among the university and local authority, students' familiesand non-resident students.

4. Support and assist non-resident students living in safe, order cultural resident place.

 

Chapter II
RIGHTS AND OBLIGATIONS OF NON - RESIDENT STUDENTS

Article 5The rights of non-resident students

1. Non-resident students are entitled the rights under current provisions of the Regulation onstudents of universities, higher colleges and professional secondary schools in the formal trainingsystem issued by the Ministry of Education and Training.

2. Non-resident students are entitled the rights of citizens residing in the locality, facilitated and helped by the local government and universities.

3. Non-resident students are entitled to appeal and propose to local government, rector of university and other relevant agencies for issues related to rights and legitimate interests in the resident place.

Article 6Obligations of non-resident students

1. Non-resident students perform obligations under current provisions of the Regulation on students of universities, higher colleges and professional secondary schools in the formal training system issued by the Ministry of Education and Training.

2. Non-resident students perform civil obligations as prescribed by law. Non-resident students comply with  regulations on security and order, social security, participate actively  in cultural and performing activities,  sports, prevention and protection from crime and evils social, and protect living environment and activities organized by local authorities.

3. Non-resident students must register temporary residence with the police of communes (wards, towns) and report universities about their non-resident address within 30 days from the date of enrollment.
4. When there is a change of resident place, non-resident students must inform their new resident place to universities within 20 days.

5. Non-resident students have permanent resident census and are residing at place registered resident census have to implement obligations specified in Section 1, 2 and 4 of this Article.

 

Chapter III
AFFAIRS OF NON - RESIDENT STUDENTS

Article 7. Affairs of the management of non-resident students


1. Disseminating regulations of the Ministry of Education and Training and universities about affairs of non-resident students and guiding and consulting procedures of temporary residents soon as admission.

2. Planning annually to implement affairs of the management of non-resident students.

3. Establishing records of non-resident students (Appendix II) and updating fully and timely changes of resident places of non-resident students.

Article 8Coordination

1. Planning and coordinating with local authorities to understand the situation of the boarding -houses to advise and recommend accommodation for students available requirements.
2.  Coordinating actively with local authorities, police offices and relevant sectors to organize annual briefing meetings between universities and local authorities on the situation of non-residentstudents and to decide promptly incidents related to non-resident students.

3. Coordinating with Ho Chi Minh Communist Youth Union, Viet Nam Student Association, Viet Nam Youth Union Association, other socio-political organizations related to consult, support, assistand organize performance of affairs of non-resident students.

           

Chapter IV
RESPONSIBILITIES OF RECTORS OF UNIVERSITIES,
DIRECTORS OF DEPARTMENTS OF EDUCATION AND TRAINING

Article 9Responsibilities of rectors of universities


1. It is based on the specific conditions of universities, the organization to implement of non-resident students is under the provisions of Chapter III of this Regulation.

2. Approving annual plans of affairs of the management of non-resident students of universities and directing and organize implement.

3. Arranging staff to work for affairs of non-resident students.

4. Ensuring conditions to promote the role of organization of Ho Chi Minh Communist Youth Union, Viet Nam Student Association, Viet Nam Youth Union Association in affairs of non-resident students.

5. There are mechanisms of coordination with the local authorities to facilitate conditions for non-resident students to perform fluffily their rights and obligations.

6. Coordinating with the Department of Education and Training to consult and propose to People's Committees of provinces directly belonging to the central government to direct the affairs of non-resident students in accordance with specific conditions of localities

Article 10Responsibilities of the Director of Education and Training

1. Directing implementation, checking, evaluating and reviewing preliminarily annual the affairs of non-resident students with contents of this Regulation for the schools under management of the Departments of Education and Training.

2. Consulting People's Committees of provinces and cities directly belonging to the Central Government to promulgate regulations for the management of boarding houses for students andregulations coordinated management of non-resident students.

 

3. Chairing and coordinating with departments and sectors in local universities, universities , higher colleges and professional secondary schools to inspect  and assess of the situation  of non-resident students.

 

 

 

 

 

Chapter VI
Organization of Implementation

 

Article 11Reporting Regime

 

1. Universities promptly report to the Ministry of Education and Training and agencies directlyrelated incidents occurred related to non-resident students.

2. At the end of academic year, universities organize the final review meeting to assess  affairs ofnon-resident students  and report to direct managed agencies and at the same time submit to the Department of Education and Training (the Appendix I).

3. Departments of Education and Training collect and evaluate the situation of affairs of non-resident non- resident students in the area and report to the Ministry of Education and Training after the end of the school year.

 

Article 12. Inspection, commendation and discipline

 

1. The Ministry of Education and Training, Departments of education and training and universities, according to competent authority, organize the inspection and assess the implementation of affairs of non-resident students annually.

 

2. Non-resident students  violate the Section 3, Article 6 of this Regulation, they will be disciplinedthe reprimand form by universities; violation of the Section 4 of Article 6 of this Regulation, they will be disciplined the reprimand at the first violation, for the next violations in the school year, they will be disciplined in the warning form; other violations, they will be  disciplined under disciplineframework of the Regulation on students of universities, high colleges and secondary professionalschool of the formal training system.

 

3. The collective units and individuals achieving in affair of non-resident students are considered to commend as prescribed.

Chapter I


GENERAL REGULATIONS

  

Article 1. Non-resident students  are citizens who are learning and training in universities, highercolleges , professional training school, Centers for Regular Education, Centers for Employment Services and vocational training facilities (so-called as universities) and are certified to take registered procedures in non-residency under the Resident Law. They include namely:

1. Students stay with their families, their parents, brothers and sisters (who are responsible forsupport them).

2. Students live with relatives, etc.

3. Students rent boarding houses, rooms outside of universities.

Article 2Subjects of adjustment.


1. This Regulation of adjustment are for universities, agencies, departments, sectors and units, thesocial organizations involved in the affairs of the management of non-resident students

2. Staff in affairs of management of non-resident students, householders houses or rooms for lease and functional officers involved in affairs of  the management of non-resident students.

Article 3Scope of adjustment.
This Regulation modifies the operation behavior of organizations and individuals involved in the management of non-resident students in territory of Thai Nguyen province.

Article 4Principles of adjustment:

- The affairs of management of non-resident students must ensure compliance with provisions oflaw. Any violations of law must be detected and treated promptly.

- The Provincial People's Committee encourages individuals and organizations involved in facilitate conditions to ensure accommodation and living conditions for students renting to reside. It forbids strictly taking advantage of renting houses to have activities of law violations.

Article 5. Non-resident students must comply with and abide by all guidelines, and policies of the Communist Party and laws of the State, the Residence Law and the rules and regulations of theMinistry of Education, universities, and provisions of the local governments where students are permitted temporary residence.

Article 6. Universities, higher colleges, professional secondary schools, vocational training school and regular education centers; local governments and other agencies such as Police, Tax,Construction Management, Natural resources and Environment should organize collaboration of professional responsibilities related to the construction of the boarding -houses, houses for business, environmental sanitation, the management of non-resident students under functions and tasks defined.

 

Chapter II
SPECIFIC REGULATIONS FOR NON-RESIDENT STUDENTS

 

Article 7. Non-resident students  are entitled to get the rights and obligations of citizens, must comply exemplary with guidelines and policies of the Communist Party and laws of the State, to observe the provisions of the law on residence, the regulations of local governments and regulationsand rules of universities and the regulations of this Regulation.

 

Article 8. Non-resident students must take non-registration form under the prescribed formcertified by universities and public security of communes, wards and towns in the inn. Non-resident students change their resident places, they must report householder, public security of communes, wards and towns and have to re-apply for change of residence with universities and take procedures for temporary resident registration at the public security of wards, communes and towns under the provisions of the Residence Act. At the end of a semester and academic year, non-resident students must submit the certification of non-resident students under prescribed form for the public securityof wards, communes and town to certify.

- Non-resident students forbid strictly to violate one of the following behaviors:

1. Keeping, trafficking, transporting and using weapons, dangerous weapons, explosives, fire substances, fireworks and hazardous substances.

2. Keeping, trafficking, transporting and using illegally any form of addict stimulant drugs such asopium, heroin and preparations of drugs.

3. Keeping, distributing, spreading films, video tapes, audio tapes and other cultural products with contents of obscenity, pornography, violence, enemy's warfare documents or documents of magicpagan propaganda and joining in pagans, beliefs, religion in unlawful.

4. Organizing or participating in activities of gambling, lottery games, bets and pornographic acts and prostitution in any form.

5. Fighting or inciting to fight each other, organizing gangs, factions gathered to disturb public orderand organize and participate in racing or promoting illegal vehicle race in any form.
6. Destroying, stealing of state's property, private property of citizens or rapping, robbing, snatching assets of citizens.

7. Acting unculturally, making public disorder, causing environmental pollution.

8. Taking outsiders into student's room out of the time specified. Organizing alcohol and beer drinking, dance, music causing noise disorder and other unlawful acts.

 

Chapter III


RESPONSIBILITIES OF UNIVERSITIES, HIGHER COLLEGES,
Professional secondary SCHOOLS, vocational TRAINING schools and centers ANDFACILITIES OF VOCATIONAL TRAINING

Article 9. Responsibilities of universities, higher colleges, professional secondary schools,vocational training schools, centers and facilities of vocational training are as follows

1. Educating regularity students to raise awareness in politics - thought, law, resident law, knowledge of prevention and protection from crime, social evils and being vigilant to protect order security.


2. Establishing and promulgating specific regulations for non-resident students such as: proceduresof documents, forms for non-resident students and certain regulations forms of commendations ordisciplines for non-resident students. Grasping thoroughly for students to implement the Regulation of the management of non-resident students issued by the Provincial People's Committee.

3. Doing not settle for non-resident students, who  work in agencies of the Communist Party, State,armed forces, civil unions, Fatherland Front, to live on the campus of worship places, religious practices of religious organizations such as temples, pagodas, churches. Doing not permit non-resident students renting houses of families available members related to crime, lottery games, betsand pornographic acts and prostitution or business of restaurant, beer, coffee, karaoke, dancing halls

4. Establishing notebooks to monitor and manage non-resident students. Planning actively tocoordinate with local governments, police agencies and resident groups to check regularly non-resident students.

5. Collaborating with police agencies and other relevant sectors to solve quickly, definitely incidents caused by and related to students and deal strictly with violations. After treating violations of non-resident students, it should be discussions with local police to coordinate the management ofeducation.

Article 10. Universities should built spacious, clean and beautiful dormitories in order to attractstudents living in dormitories managed by universities. Universities must have specific guidance onprocedures for non-resident students and the system of notebooks to monitor, check and assessperiodically for non-resident students.

 

Chapter IV
RESPONSIBILITIES OF HOUSEHOLDERS AVAILABLE

HOUSES FOR students RENTING

 

 

Article 11. Households available houses for students renting must implement fully procedures in accordance with regulations of business conditions for renting accommodation via the Decree No.08/2001/ND-CP dated on February 22, 2001 of the Government and the Province's regulationsspecified in the provisions of this Regulation. It is only to lease for students, who are to take fully allprocedures prescribed by the Resident Law. Boarding houses and families available students renting residence need to have good conditions and fulfills seriously the following basic provisions:

1. Houses for students renting must have a specific address: room number, house number, name of village, resident group, streets, wards, communes etc. Landlords must be persons availablepermanent or temporary resident registered census in places for lease.

2. Living houses must ensure safety standards on building structures and environmental sanitation in accordance with the State's regulations regarding construction and the environment, as well as implement seriously regulations of local governments.

3. Making sure conditions of public order and safety, safety in fire prevention and fire fighting,explosive prevention, poisoning prevention, environment sanitation, electricity, daily used water andimplement of obligations with the State.


4. Householders available students renting accommodation must have rules of boarding houses andcheck regularly implementation of rules and have notebooks to monitor resident students,  declarefully and timely temporary resident registration about resident students and students changing temporary resident places to police agencies of communes, wards, towns and universities.

5. Householders are responsible for creating favorable conditions for universities, competent authorities to check students and report checking delegation regarding on the observance of law,regulations and rules, village regulations of students at temporary resident places.

6. When landlords found that students have lawful violations or cause incidents related to securityorders, landlords must report as soon as to the Police 113, police agencies of communes, wards and towns and resident groups to solve.

 

Chapter V
RESPONSIBILITIES OF PEOPLE'S COMMITTEE OF LEVELS

Article 12. People's Committees of districts, cities and towns should direct the implementation ofthe following contents:

1. Directing coordination among relevant agencies in localities on resident managing.  organizing the implementation of legal norm documents on residency in the localities;
Synchronically organizing propaganda and education to raise awareness for their local citizensregarding the resident law and checking, inspecting and settling complaints and denunciations and treating lawful violations under regulations of the law.

2. Directing Committees of communes, wards and towns having universities located in and non-resident students  to do well the state management on security orders, conditions for business registration, rental accommodation prescribed in the Decree No. 08/2001/ND-CP dated on February22, 2001 of the Government and the regulations on construction and environmental hygiene.

 

3. Establishing and issuing documents directing and checking and supervising the implementation ofdirectives and regulations on the management of security orders, prevention and protection fromsocial evils, civilized lifestyle, building agencies, villages, resident groups  communes, wards,  townsin culture and environmental hygiene throughout nationwide.

Article 13. People's Committees of communes, wards and towns are

1. to be responsible for directing functional forces under their management, to carry out well  themanagement of  permanent resident registration and temporary resident registration, without anycomplicated case that makes difficult for the state management on security orders in the localitiesmeans.

2. to deploy guidelines to the resident groups, villages and business households for renting houses about documents of the National Assembly's Law, the Decree of the Government, the Circular of the Ministry of Public Security  including:

- Resident Law approved by National Assembly at the 10th meeting session on November 29, 2006.
- The Decree No. 107/2007/ND-CP dated on June 25,2007 of the Government on detailing regulations and guiding the implement of some provisions of the Resident Law.

- The Circular No. 06/2007/TT-BCA-C11 dated on July 1, 2007 on guiding the implement of some provisions of the Resident Law

- The Decree No. 08/2001/ND-CP dated February 22, 2001 of the Government on condition of security orders for some business sectors and fields with conditions.

- The Decree No. 150/2005/ND-CP dated on December 12, 2005 of the Government on regulationsof administrative sanctions in the field of security orders and social security.

- The Decree No. 11/2006/ND-CP dated on January 18, 2006 of the Government regardingpromulgation of regulations of cultural activities and business of public cultural services.

- The Decree No. 56/2006/ND-CP dated on June 6, 2006 of the Government on administrative sanction  in  activities of cultural - information.

3. Deploying the documents specified on construction, environmental sanitation: wards, cities,villages, hamlets, resident groups implement civilized life style, cultural families, environmentalhygiene for streets, villages etc. At the same time, urging to take into implement regularily the above regulations.

Article 14. The resident groups, villages and hamlets are:

To inspect, urge and remind regularly householders and students implementing well the provisions ofresident groups, villages, local governments and laws of the State. To inform timely and coordinateto help police agencies and universities to check for non-resident students and resolve the incidents occurring.

 

Chapter VI
RESPONSIBILITIES OF AGENCIES OF PUBLIC SECURITY

Article 15. Provincial Department of public security should do well the following tasks:

1. Giving consultancies to the provincial Peoples' Committee policies and measures on the assurance of security orders for student of universities, higher colleges, vocational centers andvocational training institutions located in the locality. Giving consultancies the managing board ofuniversities to set out the guidelines and active measures to ensure the maintaining of security orders in universities and to implement effectively management of students.

2. Directing subordinate public security on professional duties. Checking and guiding subordinate public security to work effectively the state management on security orders. Solving timely from the locality those incidents related to students.

3. Strengthening to direct the police force at localities to work effectively on consultancy with the Party Boards, administration governments, universities, communes, wards and towns on the propaganda, mobilization of residents engaging in launching the movement of all residents to protectnational security.  Improving continuously awareness for officials and public employees - teachersand residents on complying with the Resident Law, obligations of fight against types of crimes, drugs, social evils and maintenance of a clean environment.

Article 16. Agencies of public security of districts, cities, towns should do well the following tasks.
1. Reporting, giving consultancies and proposing timely to the Party Boards, administration governments at the same level to work effectively the State management of security orders, and observance of the Residence Law, solving timely from the localities incidents related to students and at the same time, exchanging via writing documents with universities about results of treatments forstudents of violations.

2. Deploying and guiding agencies of public security of wards, communes and towns on law documents issued by the National Congress, the Government's Decrees, the Circular of the Ministry of Public Security including the provisions in Section 2 of Article 13 of this Regulation.

3. Directing agencies of public security of wards, communes and towns to implement well the Resident Law, the duty of inspection and management of registration on permanent residence,temporary residence and temporary absence and dealing well incidents occurring at localities underfunction, at the same time coordinating with universities, the provincial police to deal promptly the incidents related to students. After treatment for each incident, each student violations, police agency must give written notice to the universities to know about violated contents, treated form for further monitoring and management.

4. Implementing well the evaluation and issuing certifications of qualification on security orders,fire prevention and fire fighting for business households as prescribed. Instructing agencies of public security of communes, wards and towns to implement provision of the certificates of temporary resident registration for non-resident students in the locality.

Article 17. Agencies of public security of communes, wards and towns should implement well the following tasks: 

1. Posting publicly, guiding agencies, organizations, individuals, households in the implementationof the provisions of the Resident Law. Arranging qualified and good moral staff to work ofregistration and resident administration. Within 3 working days after receipting of all documents of application for non-resident registration of students, Agency of public security of locality shouldimplement urgently the issue of the certificates of registration on permanent residence, temporary residence in the locality in accordance with the Resident Law. Do not settle for non-residentapplications of students working at agencies of the Communist Party, State, armed forces, the union organizations, the Fatherland Front to live in places of worship, religious practices of religious organizations such as temples, pagodas, churches. Preventing for students  rent houses of families available members related to crimes, social evils: Drugs, gambling, lottery gamble, prostitution orrestaurant business, beer, coffee, karaoke and dance halls.

2. Managing, keeping profiles and documents related to registration and  administration of residency.Compiling notebooks for monitoring non-resident students for managing. Checking regularly and urging the declaration of temporary residency, temporary absence of students and householders forlodging.

3. Coordinating with universities available non-resident students to manage and solve promptly andthoroughly petitions, complaints and denunciations of citizens related to students. Notifyingpromptly universities to know treatment of students' violations in locality to coordinate education.

4. Coordinating the departments and functional sectors in communes, wards and towns, districts andcities to check households and students of violations of the policies, laws and regulations of the Communist Party and the State and localities.

5. At the end of each semester and the academic year, signing certificates of non-resident students(issued by universities) about the advantages and disadvantages in the observance of the policy andlaws of the State and local governments.



 


Chapter VII
REWARD AND DISCIPLINE

 

Article 18. Organizations and individuals available achievements in the management of non-resident students will be awarded according to current regulations.


Article 19. Organizations and individuals have acts of violations in the implementation of theRegulation of the management of non-resident students, depending on levels of seriousness of their violations, they are treated administratively under the current regulations of the State, Ministry ofEducation and Training, universities and the local governments or prosecuted for criminal liability.

 

 

 

 

Chapter VIII
Organization of implementation

 

Article 20. Department of Education, Thai Nguyen University and the Department of Labor, War Invalids and Social Affairs is responsible for

 

1. Promulgating documents of regulations on student management, forms of commendations anddisciplines for non-resident students. Inspecting and urging universities, vocational training schools, centers related to implement well the direction of the provincial People's Committee and superior management agencies on management of boarding students and non-resident students.

2. Developing the plan and directing universities directly belonging to plan of budget estimation for implementation of the management of non-resident students.
3. Directing universities, centers, vocational training institutions, members units to implement well the management of non-resident students.

Article 21. The tax agency, the Department of Construction, the Department of Natural Resources - Environment are responsible for formulating and promulgating documents of regulations on tax revenue for leased accommodation, construction of houses, environment sanitation; and regularlyexamining the implementation of these regulations.

Article 22. Annually, the Provincial Public Security is responsible for  active coordination withSector of Education & Training, the Department of Labor, War Invalids and Social Affairs to organize a preliminary evaluation of the results to implement the Regulations on Management ofnon-resident students with universities and other relevant agencies in order to assess  difficulties and advantages in implementation of the Regulation of the management of non-resident students and proposing solutions to overcome for good implementing  this Regulation.

Article 23. Once every 6 months, universities should organize actively the workshop of preliminaryassessment to withdraw experiences for staff working in management of non-resident students and with police forces directly involved in the management of these students as well as finding out and set forth  directions to overcome existing difficulties in the implementation of the Regulationthrough which it can replicate the example individuals working effectively on the  management of non-resident students.

 

Article 24. Quarterly universities should chair to organize and collaborate with People's Committees where non-resident students live in, Public Security, check actual whereabouts of  non-resident students to evaluate the situation on their life and daily living of non-resident students.

THE DECISION OF
Credit for students


THE PRIME MINISTER HAS HEREBY

 

Pursuant to the Law of Government Organization dated on December 25, 2001;

Pursuant to the Decree No. 78/2002/ND-CP dated on October 4, 2002 and issued by the Government on credit for the poor and other policy objects;

Considering at the proposal of the Minister of Finance,

 

DECIDED

Article 1. Scope of application:

The credit policy for students is applied to support students with difficult circumstances tocontribute to cover costs of education and daily living of students in time at universities. It includestuition fees, purchasing books, studying facilities, the food cost, accommodation and travel.

Article 2. Students in priority are borrowed money:

Students  with difficult circumstances are attending in universities (or equivalence universities), Higher colleges, professional secondary schools, vocational training schools, centers and facilities of vocational training established and operated under the provisions of the law of Viet Nam. They are as follows

1. Students orphaned from both parents either only father or mother, but other one can not havecapacity to work.

2. Students are members of households belonging to one of the priority objects, namely:

 - The poor households are under the standards prescribed by law.

  - Mean household income per capita reaches maximum 150% of that income of the poorhouseholds as prescribed by law.

3. Students, whose families have financial difficulties due to accident, illness, natural disasters, fires, epidemics in the period of study, have certificates from the People's Committees of communes, wards or towns where they live.

Article 3. Lending methods:

1. Loans for students are implemented by the method of lending through households. The representative of household is the person borrowing directly and being responsible for repaying The Bank for Social Policies. In case of students orphaned from both parents either only father or mother, but other one can not have capacity to work, those students can borrow directly in The Bank for Social Policies where universities is located in.

2. The Bank for Social Policies has responsible for implement loans for students

Article 4. Loan conditions:

1. Students, who are living in lawfully resident households in the locality, meet the criteria specifiedin Article 2 of this Decision.

2. For first year students, they must have enrollment notices or certificates of admission touniversities.

3. For students from the second year onwards, students must be certified by universities that they arestudying in universities and not be subject to administrative sanctions or more due to the following acts: gambling, drug addiction, theft and smuggling.

Article 5. Capital amount of loan:
1. Loan level is  up to VND 800,000  per month per student.
2.. The Bank for Social Policies regulates specific lending amount for students, it is based on tuition rates of each university and living expenses under each region, but does not exceed the loan amountsspecified in Section 1 of this Article .

3. When tuition policy of the State is changed and daily living prices fluctuated, The Bank for Social Policies has agreement with the Minister of the Minister of Finance and submits to the Prime Minister for consideration and decision to adjust loan level.

Article 6. Loan term:

1. The lending period is calculated from the borrowed date of students begining to receive the loanuntil full debt repayment (principal and interest) mentioned in the credit contract. Loan term include the loan term and the repayment period.

2. Term of distribution of loan is from the date of loan persons receiving the first loan amount tofinish the course of students, including limited permitted studying off period and retaining academic results of students (if any). Duration of loan distribution for students are divided into terms of loan periods stipulated by the Bank for Social Policies  or agreed to borrowing students

3. Debt repayment period is the period from the first loan date to all debt repayment (principal and interest). For the training program with training duration not exceeding one year, the debt repayment period is two times in maximum equal to term of loan distribution. For other training programs, the maximum repayment term is equal to term of loan distribution. Debt repayment period is divided into the debt repayment period stipulated by The Bank for Social Policies.

Article 7. Lending rate:

1. Preferential lending rate for students is 0.5% per month.

2. Overdue debt interest rate is equal to 130% interest rate when loans.

Article 8. Profiles for loan, order and procedures for borrow and debt repayment:
The Bank for Social Policies regulates profiles of loan application, order and procedures forborrowing and debt to ensure simple, clear and easy to implement.

Article 9. Repayment of loan principal and interests:

1. Within period of distribution of loan for the borrower who do not to pay principal and interest;loan interest is calculated from the date the loan to get the first loan amount to repayment date.

2. Borrowers must repay principal and interests for the first borrowing amount as soon as studentshave jobs and income and without exceeding 12 months from the day that students finish the academic course.

3. Each repayment rates specific by the Bank for Social Policies and guidelines and agreement in thecredit contract.

Article 10. Preferential interest rates in case of debt repayment in advance:
In case  borrowers has repay in pre-mature period committed in the credit contract, the interest ratewill be reduced by loan interests. The Bank for Social Policies specifies the preferential interest ratein case of pre-mature repayment.

Article 11. Adjustment of repayment period, repayment extension and transferring of overdue debts:
1. By the  final repayment mature period, the borrower have difficulties and can not repay  debts, they must make a requested documents for extension and shall be considered debt repayment extension by the Bank for Social Policies; the debt extension period is a maximum half -time of the repayment period.

2. In cases borrowers do not pay timely by the final repayment mature period and are not allowed toextend debts, The Bank for Social Policies changes those debts to delinquency. The Bank for Social Policies coordinates with local governments, social -political organizations   to have measures to collect debts.

3. The Bank for Social Policies shall specify the adjustment of repayment period, repayment extension and transferring of overdue debts 

Article 12. Treating risks due to objective reasons:

The debt settlement with risks due to objective reasons shall be implemented  in accordance with the regulations on debt settlement with risks of The Bank for Social Policies

Article 13. Responsibilities of agencies:

1. The Ministry of Finance chairs and collaborates with the Ministry of Planning and Investment toallocate  the State's funds  for students borrowing and funding different offset amount of interestrates, management fees in order to the Bank for Social Policies performing well for student loans.

2. The Ministry of Education and Training, the Ministry of Labor - Invalids and Social Affairs, otherministries and sectors

a) Direct universities, higher colleges, professional secondary schools and vocational trainingfacilities under their management to coordinate with the local People's Committee and The Bank for Social Policies to organize implementation of credit policy for students

b) Direct universities, higher colleges, professional secondary schools and vocational trainingfacilities to certify students studying there in the qualification for loans as specified in Section 2 and 3 of Article 4 of this Decision.

3. People's Committees of provinces and cities directly belonging to the Central Government directfunctional agencies and People's Committees at all levels to implement the credit policy forstudents in accordance with the law and this decision.

4. The Bank for Social Policies shall be responsible for guiding to take loan application, orders and procedures for loan, repayment period, repayment rates, extending repayment, transferring overduedebts for students as prescribed. It mobilizes capital to add loan funds for students. It coordinates closely and regularly with universities, higher colleges, professional secondary schools andvocational training institutions in the lending process in order loan capitals used correctly purposesand facilitate favorable conditions for students in receiving loans and paying tuition fees.

5. Organizations and individuals using students as labors borrowed capitals of the State under thisDecision shall be responsible for urging students to transfer money to families to pay or direct payliabilities for the Bank for Social Policies.

Article 14. Treatment of violations:

Organizations and individuals do not implement correctly regulations on credits for students,specified in this Decision, depending on levels of seriousness of violations, they will be treated according to regulations of law.

Article 15.  Provisions of implementation

1. This Decision takes effect as of October 1, 2007 and replaces the Decision No.107/2006/QĐ-TTg dated on May 18, 2006 of the Prime Minister regarding credits for students. Students  loanedcapitals by the Decision No.107/2006/QĐ-TTg dated May 18, 2006 will continue borrow capital under the provisions of this Decision.

2. The ministers, deans of ministerial-level agencies, heads of agencies directly belonging to the Government, presidents of People's Committees of provinces and cities directly belonging to the Central Government, the Chairman of the Administration Council and the General Director of  the Bank for Social Policies are responsible for implement this Decision.
